1. Acceptance of Terms
By accessing or using the ClearArrival platform, website, mobile application, or any related services (collectively, the "Services") operated by ClearArrival, LLC, a Texas limited liability company ("ClearArrival," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business or entity, you represent that you have the authority to bind that entity.
If you do not agree to these Terms, do not use the Services.
2. Description of Services
ClearArrival provides a real-time technician tracking and customer communication platform for trades businesses including but not limited to HVAC, plumbing, roofing, electrical, pest control, landscaping, and other field service industries. The Services include:
• A dispatcher dashboard for creating and managing service jobs
• A technician mobile application for iOS and Android devices
• Real-time GPS tracking links delivered to customers via SMS and email
• Customer-facing tracking pages accessible via unique token-based URLs
• Automated customer notifications including morning-of queue position and on-my-way alerts
• Post-service survey and review prompt tools
• Automatic service record generation including before and after photos
• Analytics and performance reporting for business owners
ClearArrival is NOT a payment processing platform, invoicing system, or financial services provider. We do not collect payments on behalf of your customers, process transactions between you and your customers, or provide any financial advice.
3. Account Registration
To access the Services you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at legal@cleararrival.com of any unauthorized use of your account. ClearArrival will not be liable for any loss or damage arising from your failure to protect your account credentials.
You must be at least 18 years of age to create an account. By creating an account you represent and warrant that you are at least 18 years old.
4. Subscription Plans and Billing
4.1 Plan Tiers
ClearArrival offers the following subscription plans:
• Starter Plan: $49.00 per month flat rate for up to 2 technicians
• Growth Plan: $29.00 per technician per month for 3 to 25 technicians
• Enterprise Plan: Custom pricing for 25 or more technicians, subject to a separate Enterprise Agreement
• Pause Plan: $9.00 per month, available for up to 3 months per calendar year
4.2 Annual Billing
Annual billing is available at a 20% discount off the monthly rate. Annual subscriptions are billed in full at the beginning of each billing cycle and are non-refundable except as described in Section 4.6.
4.3 Free Trial
ClearArrival offers a 14-day free trial for new accounts. The trial is limited to a maximum of 10 technicians regardless of selected plan. No credit card is required to start a free trial. At the end of the trial period, your account will pause unless a valid payment method is added and a subscription is activated. Your data will be preserved for 90 days after a trial expires before permanent deletion.
4.4 Automatic Renewal
Monthly subscriptions automatically renew on the same calendar day each month. Annual subscriptions automatically renew on the anniversary of the subscription start date. You authorize ClearArrival to charge your payment method on file for all renewal amounts. You may cancel auto-renewal at any time from your account settings.
4.5 Proration
When you add technicians mid-billing cycle the additional technician cost is prorated based on the number of days remaining in the current billing period. When you remove technicians the reduction takes effect at the start of the next billing period.
4.6 Refund Policy
Monthly subscriptions are non-refundable. Annual subscriptions may be refunded on a prorated basis within the first 30 days of the annual term if you notify us at billing@cleararrival.com. After 30 days of an annual term, no refunds are provided. Free trial periods are not eligible for refunds.
4.7 Payment Processing
Payments are processed by Stripe, Inc. By providing payment information you agree to Stripe's Terms of Service and Privacy Policy. ClearArrival does not store raw payment card data. All payment information is encrypted and handled by Stripe in compliance with PCI-DSS standards.
4.8 Failed Payments and Account Suspension
If a payment fails, ClearArrival will attempt to collect payment on days 1, 3, and 7 following the failure. If payment is not collected within 14 days of the initial failure, your account will be suspended. Suspended accounts retain their data for 90 days. You may reactivate your account at any time by providing a valid payment method.
5. Technician Location Data
The Services collect GPS location data from technician mobile devices. You acknowledge and agree to the following:
• Location data is collected only when a technician actively taps On My Way for a specific job and stops automatically when the job is marked complete
• Location data is not collected in the background when technicians are off duty or between jobs unless an active job is in progress
• Location data is stored for 30 days in ClearArrival systems and then automatically deleted
• You are responsible for obtaining all necessary consents from your technicians for the collection of their location data
• You represent and warrant that you have informed your technicians that their location is tracked during active jobs using ClearArrival
• ClearArrival complies with applicable laws governing employee location tracking in the State of Texas
6. SMS and Customer Communications
By using the Services you authorize ClearArrival to send SMS text messages and emails to your customers on your behalf. You represent and warrant that:
• You have obtained all necessary consents from your customers to receive automated text messages about their service appointments
• Your customers have provided valid mobile phone numbers for the purpose of receiving service communications
• You will not use the Services to send spam, unsolicited commercial messages, or any communications that violate the Telephone Consumer Protection Act (TCPA) or CAN-SPAM Act
ClearArrival's SMS messages include the name of your business and an opt-out mechanism. Standard carrier messaging rates may apply to your customers.
7. Job Photos and Service Records
The Services allow technicians to upload before and after photographs of job sites. By using this feature you represent and warrant that:
• You have obtained all necessary permissions to photograph the properties where your technicians work
• You have informed property owners that photographs may be taken as part of the service documentation process
• You will not upload photographs containing personally identifiable information of individuals without their consent
Photos are stored securely and are accessible only to your account users and the customer associated with the specific job. Photos are retained for the life of the account plus 90 days after account closure.
8. Acceptable Use
You agree not to use the Services to:
• Violate any applicable federal, state, or local law or regulation
• Infringe the intellectual property rights of any third party
• Transmit any content that is unlawful, defamatory, harassing, or fraudulent
• Attempt to gain unauthorized access to ClearArrival systems or other user accounts
• Reverse engineer, decompile, or disassemble any portion of the Services
• Use the Services to track or monitor individuals without their knowledge or consent
• Resell or sublicense the Services without prior written authorization from ClearArrival
• Use the Services in any manner that could damage, disable, or impair the platform's performance
9. Intellectual Property
The Services and all content, features, and functionality including but not limited to software, text, graphics, logos, and icons are owned by ClearArrival, LLC and are protected by Texas and United States copyright, trademark, and other intellectual property laws.
You retain ownership of all data you upload or create through the Services including job records, customer information, and photographs. You grant ClearArrival a limited, non-exclusive license to use this data solely to provide the Services.
10. Confidentiality
Each party agrees to keep confidential any non-public information of the other party that is disclosed in connection with the Services and is identified as confidential or should reasonably be understood to be confidential. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEARARRIVAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES.
IN NO EVENT SHALL CLEARARRIVAL'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID CLEARARRIVAL IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLEARARRIVAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
13. Indemnification
You agree to indemnify, defend, and hold harmless ClearArrival and its members, managers, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses including reasonable attorney fees arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas without regard to conflict of law provisions. Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to personal jurisdiction in those courts.
Before filing any legal action, the parties agree to attempt good-faith negotiation for a period of 30 days following written notice of the dispute.
15. Changes to Terms
ClearArrival reserves the right to modify these Terms at any time. We will notify you of material changes by email and by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
16. Termination
You may terminate your account at any time from your account settings. ClearArrival may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination your data will be retained for 90 days before permanent deletion.
